A breaking story in Wisconsin this morning is a ruling from our Supreme Court that a school district must release online pornography viewed by a teacher on his work computer to the Milwaukee Journal Sentinel, which had filed an open records request seeking the porn pics.
But the teacher objected, questioning whether the release of the pictures would violate copyright law and whether a citizen’s privacy outweights the public interest in the pictures.
The Supreme Court ruled the pictures qualify as records under the fair use exception to copyright infringement. The court goes on to say the presumption that records should be open for review trumps the teacher’s privacy.
