Tennessee judge seeks restraining order to prevent release of embarrassing audiotape

In Tennessee, the Chattanooga Times Free Press is seeking access to an audiotape recording of Tennessee Circuit Court Judge John Hagler. The tape recording that is sought was found by a legal secretary several years ago when she was transcribing a tape of legal dictation.

Evidently, the words said by Judge Hagler on the tape are of a sexual nature, and would be highly embarrassing to Hagler and his family if the tape becomes public.

The tape is in the possession of the city of Chattanooga, although how it came into their possession is not clear. That city’s attorney determined that there are no exemptions barring the release of the tape to the Chattanooga newspaper. However, Judge Hagler’s attorney successfully sought a restraining order barring the tape’s release earlier this week. The newspaper is contesting that restraining order.
