Montana: Working drafts of city documents are FOIAable

Good! In Montana, State District Judge Wayne Phillips ruled that the city of Great Falls can’t withhold documents from a citizen looking for them on the excuse that the documents are drafts.

The ruling resulted from a lawsuit filed by the Montana Environmental Information Center when their requests for agreements between the city of Great Falls and Southern Montana Electric Generation & Transmission Cooperative were rejected.

I started to occasionally follow the story of citizen attempts to get copies of these agreements back in December 2006. The Electric City Weblog has been following this story (and filing many FOIAs) since the beginning.
